Short Films from Harvard Law Students Illuminate Issues of Justice — and Injustice

The law can be viewed as a menacing force to intimidate and coerce. But what happens when the law is challenged to right a wrong or create constructive change? Led by Harvard Law School Professor Martha Minow and producer Joseph Tovares, twelve Harvard Law students set out to explore that intersection in LEGAL LENS, premiering Monday, June 28 on WORLD Channel’s LOCAL, USA with additional, exclusive shorts on YouTube. Through five short films featuring captivating profiles and passionate characters, the series examines how laws and regulations can either disrupt lives or lead to positive shifts, depending on how they are interpreted or contested.

“I’ve often thought it may seem strange, but that the closest activity to law, and law practice, is documentary filmmaking, because in a similar, maybe surprising way, we have to deal with the actual reality. This is not fiction. And at the same time, no one would deny there’s a shaping, there’s a choice-making, there’s a set of selection decisions,” Minow says.

The similarities between studying law and creating documentary films may not be obvious, like Minow suggests, but consider the larger themes of both: Lawyers craft stories to win their cases; documentarians lead viewers through a focused narrative to bring attention to an issue.

But more than the industries’ parallels, it’s about the reach film has when compared to law, says Kenyan LL.M. student Zamzam Mohammed, who worked to shine a light on pregnancy discrimination in the workplace. She believes the medium can raise a new kind of awareness: “You can have a case in court, and only very few people would actually be able to understand what’s going on. But then when you have a film, anybody can watch a film on the subway, you can watch it when you’re cooking dinner. And so I think it’s something that helps people understand in a way that is clear for them,” she said.

David Benger, one of a team of students who focused on prison reform, found that documentary fit in seamlessly with his mission as a lawyer: to create broader awareness that, in turn, facilitates change. “I think we, as lawyers, try to convince people, not only that we’re right, but that people should care about what we have to say. And I think filmmaking is an extremely useful tool for helping people invest emotionally in real problems that other people have,” he said.

Starting the conversation, even if it seems like no substantial progress is being made, is half the battle, says LL.M. student Adam Posluns.

“Litigation doesn’t always have to be about big victories in court…Sometimes that change can happen just by initiating lawsuits, just by starting the litigation,” he said. “Because even if you don’t win, and sometimes you won’t win for various reasons…it can get other people to see that they can also litigate these issues. They don’t have to wait for their governments to come along.”

Law, these students agree, may seem straightforward on paper, but when film becomes an element, seeing the human stories behind those laws creates an expanded consciousness and adds a new angle to the purpose of law, offering insight that may otherwise be lost.

“Narrative storytelling, especially documentary storytelling, can help lawyers do their job better and remember that this is about people. I think the thing I hate the most is when people say, ‘Oh, let’s not focus on the facts. Let’s just focus on the law,’” said Elisabeth Mabus, J.D student from Jackson, Mississippi. “The facts are the people. And the facts are the people that the law impacts. And we cannot lose sight of that.”

The umbrella of human rights is what led Minow’s class to their underlying theme: home, and how the law can have such an effect on a person’s sense of it.

“Sometimes we forget the stories behind these legal cases, or don’t pay as much attention to stories behind these legal cases we read. We go straight to the legal issue. We go to the legal arguments, principles, but it’s a gentle reminder that behind every case there’s a human story…win or lose, there’s always that human story,” Daren Zhang, California J.D student, said.

Within these five films, the stories ultimately lead back to what makes a home, and how the idea of home, that basic and fundamental right, is challenged when human rights are threatened. According to Posluns, that was the driving force behind these stories. “I think people felt that human rights were being put on the back burner, that they’re being disregarded rather than championed…That human rights had become more bargaining chips in transactions rather than something to be fought for and to be championed around the world,” he said.

By looking at issues like climate change, immigration and gentrification through a legal lens, these future lawyers began to see their profession differently. By embarking on a mission to represent their characters (Lisa Newman, a working mother; Doris Landaverde, an 18-year Temporary Protected Status holder; Damali Vidot, an unassuming but confident community leader) justly and effectively, opinions on what practicing law means began to evolve.

Kevin Patumwat, a J.D student from Bangkok, Thailand, shared how the project underscored the role of ineffective lawyering: “I think this project really drove home the importance of how lawyers need to be able to use the knowledge, use the resources they have, and really more effectively advocate for the people who they’re advocating for.”

“Ultimately when you care about an issue and you want to tell a story about an issue, there’s a great deal of value in having many different tools in your toolbox for how to tell that story and how to make people care and that this may not be a part of their direct lived experience, but it’s something they should care about,” Benger echoed.

By shifting the gaze of litigation onto honest, human stories, LEGAL LENS offers a glimpse into how there is still room for change in the way law is interpreted and enacted.

“In a lot of our national conversations, I think we focus so much on the things that divide us. We forget often how much we have in common. And we forget to see all the things that unite us,” Boston, Massachusetts J.D student Tianhao He said. “Even though the films in this series all touch on different issue areas with different characters in different parts of life, I think we do see these universal themes. These universal themes of yearning for belonging, of the struggle and also the joys of building home in America.”

One of the most daring rescue missions of the post WWII era was the Raid on Entebbe in 1976.  Terrorist groups called the Popular Front for the Liberation of Palestine and the German Revolutionary Cells hijacked an Air France plane with 248 passengers aboard.  The flight was redirected to Uganda.  The non-Jewish passengers were released and left and the crew was released but insisted on staying.  They Jewish passengers were held hostage while the hijackers demanded the release of 53 convicted terrorists from Israeli prisons.  The Israelis were given 48 hours to respond.  They chose to rescue the hostages instead of negotiating.

The commando mission was led by 30-year-old Lt. Col. Yonatan (Yoni) Netanyahu, older brother of the man who would become Israel’s Prime Minister.  All but two hostages were rescued and all eight terrorists killed in an expertly conducted mission that took just 58 minutes.  All of the Israeli soldiers survived except for Yoni whose heroism and dedication were celebrated throughout the world.  This thoughtful and stirring documentary tells his story.

The film draws on Yoni’s own words, which described the conflicts he felt about being a soldier and his passionate devotion to Israel, and on interviews with his family, his wife of four years, and the woman he was living with at the time of his death, and archival footage that shows us his gallantry and spirit.

This is a touching and inspiring story, powerfully told.  Those who die young, especially those who sacrifice themselves to save others, are often reduced in memory to a name on a memorial or elevated to superhuman proportions to protect us from thinking about how we might measure up.  This movie is filled with warm memories and specific details about a real person and what makes it so compelling is the reminder that by the time it ends we feel not just the admiration for his heroism but the sharp pain of his loss.

“Does Reality Television Do More Harm Than Good?”

Fans and foes of reality television and fans of the art of argument and persuasion of all kinds will want to tune in as the debate teams from Harvard and Columbia rev up that long-time Boston/New York competition when they take on reality television in what is being billed as “a war of words and wit” (and a form of reality television as well).  Many of these programs, like shallow voyeurism, mesmerize and inspire shameless curiosity. It is a genre replete with confrontations and the dramatic, ranging from the breakup of friendships to the implosion of marriages.

Some exceptions seem to have risen from the clutter, finding favor with fans and critics alike with uplifting content. Yet the entire genre continues to spark controversy, and generate questions. What is the real impact of reality television? Is it just a passing fad? And what does the fascination reveal about our society, and the people who watch?

Halogen TV, a network dedicated to socially-conscious entertainment, invites you to join the conversation and decide where you stand on the issue during “Does Reality Television Do More Harm Than Good?”– a debate between team members from The Harvard Speech and Parliamentary Debate Society and The Parliamentary Debate Society of Columbia University. The event provides an opportunity for some of the finest minds in America to consider all sides of the issue, and, in the process, reflect on television in general, and its potential to shape our worldview.

Those in the New York area can join them tonight.  “Cocktails + Conversation” begins at 7:30pm on Tuesday, October 4th at The Crosby Street Hotel in New York City.  The debate will be available for viewing on the Halogen website by Friday.

My Dad at Harvard

My wonderful dad, Newton Minow, was honored at Harvard this week for half a century of public service in working to make the greatest amount of choice and the broadest range of media resources available.  He talked about the five decades that have taken us from three networks with 15 minutes a day of national news programming operating under the “fairness doctrine” to the plugged-in, omni-media world we live in now.  As we commemorate the 10th anniversary of the terrorist attacks of September 11, 2001, remember that they occurred before YouTube and Twitter.  He reminded the audience that the debates about media have evolved but the issues remain:

“Television had become the dominant form of communication in our country, but there had been very little discussion about what that meant in terms of public responsibility and public interest. I was determined to start that discussion, even though I knew my speech would not be well-received,” he said, adding that his speech prompted Gilligan’s Island executive producer Sherwood Schwartz to name the ship that ran aground “the S.S. Minnow.”

Minow believes that the problems that plagued television and communication 50 years ago are still present today. He said that the discussion of public responsibility that was missing then is still neglected now….

“When President Kennedy gave his Cuban Missile Crisis speech, there were no pundits on after he gave it. They cut back to regular programming, so the public could absorb it,” she said. “I don’t know what we do about the fact that we need the public to push the country to social and political change, and leadership needs that relationship to get the public engaged, but the media has made that difficult.”

A webcast of the event, which featured Jonathan Alter of Bloomberg and Anne Marie Lipinski (formerly editor of the Chicago Tribune) is on Harvard’s site.  Now he is in Washington, D.C., where he will go to the White House for the kick-off of one of his most recent and most important projects, the Digital Promise (now called the National Center for Research in Advanced Information and Digital Technologies).

J.K. Rowling’s Harvard Speech

One of my favorite authors spoke about one of my favorite subjects when Harry Potter author Joanne Rowling addressed the graduating class at Harvard University. rowlingspeech.jpg Many commencement speakers urge the new graduates departing from the ivory tower to succeed in the real world, but Rowling encouraged them to fail and not to neglect the importance of fantasy.

I have wracked my mind and heart for what I ought to say to you today. I have asked myself what I wish I had known at my own graduation, and what important lessons I have learned in the 21 years that has expired between that day and this.

I have come up with two answers. On this wonderful day when we are gathered together to celebrate your academic success, I have decided to talk to you about the benefits of failure. And as you stand on the threshold of what is sometimes called ‘real life’, I want to extol the crucial importance of imagination.

Graduates are usually applauded for their achievements, but Rowling advised the hyper-performing graduates that it is a mistake to measure success or failure based on grades and awards. She was frank about the pain of her own failures and about what she learned from them.
